JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 467, 468, 420, 120B, 272, 273, 290/34 of the Indian Penal Code and Section 47A of the Excise Act.

Petitioner and some others were caught while they were engaged in packaging and sealing the country made and Indian made foreign liquor and in huge quantity, bottles etc. were recovered. However, the other co-accused, who were caught along with petitioner, have already been granted privilege of bail whereas petitioner is in jail custody since 03.02.2016 without having any criminal antecedent.

No.7535 of 2017 (2) dt.15-03-2017 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 35 of 2016.
