The petitioner seeks bail in Beur P.S. Case No. 383 of 2021 corresponding to Special (POCSO) Case No. 124 of 2021, registered for the offence punishable under Section 376 of the Indian Penal Code and section 4(2) of the POCSO Act. As per the prosecution case, this petitioner took away the daughter of informant (minor) and committed rape with her. It is submitted on behalf of the petitioner that petitioner is victim of honey-trap and has committed no offence. In fact the victim girl is major and is consenting party. From social media chat it appears that petitioner and the victim girl are known to each other for the last one year. Petitioner is in

Patna High Court CR. MISC. No.64329 of 2021(2) dt.22-02-2022 2/2 custody since 01.09.2021 having no criminal antecedent. Learned APP however, vehemently opposed the prayer for bail.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
