This is an application for bail in connection with Kotwali (Tilkamanjhi) P.S.Case No. 481 of 2016 registered for the offences punishable under Sections 307/34 of the Indian Penal Code and 27 of the Arms Act.
It has been submitted on behalf of the petitioner that petitioner has fired at the injured, who sustained injury, i.e., 1" x 1⁄2" x muscle deep on left side of angle of mouth but he has no intention to cause such injury, rather some altercation took place and no case is made out under Section 307 IPC is made out against the petitioner and he is in custody for the last four months. Heard learned APP also, who has opposed the prayer for bail stating that injury sustained by the injured is found to be
Patna High Court Cr.Misc. No.13170 of 2017 (3) dt.07-04-2017 2/2 grievous in nature.
Having heard both sides and considering the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.
However, learned trial court is directed to expedite the trial and try to conclude it within a period of nine months. If the trial is not concluded within the said period, petitioner may renew his prayer for bail.
