Petitioner apprehends his arrest in connection with Makhdumpur P.S. Case No.305 of 2014 for the offences registered under section 302/34 of the Indian Penal Code and 27 of the Arms Act.

The petitioner is named in the first information report and it is alleged that he, too, fired but his firing did not hit either to the informant or his wife.

No doubt, firing of Deen Bandhu Sharma hit the deceased but the first information report goes to show that this petitioner, too, participated in the alleged crime.

Therefore, I am not inclined to grant privilege of anticipatory bail

Patna High Court Cr.Misc. No.44577 of 2016 (2) dt.02-12-2016 2/2 to the petitioner. Accordingly, his prayer for bail in connection with above stated case stands rejected. However, this order shall not cause any prejudice to the competent court at the time of consideration of regular bail application of the petitioner. (Hemant Kumar Srivastava, J) N.H./- U T
