2. Petitioner seeks regular bail in connection with Athmalgola P.S. Case No. 48 of 2025 in a case registered for the offences punishable under Section 103(1) of the B.N.S. and chargesheet has been submitted u/s 103(1), 238, 3(5) of the B.N.S.

3. As per prosecution story, dead body of one Deepak Kumar was found and subsequently during investigation the name of the petitioner transpired as one of the accused persons involved in the murder.

4. Learned counsel for the petitioner submits that the informant is not an eye witness of the alleged occurrence. Petitioner is not named in the FIR. The name of the petitioner

Patna High Court CR. MISC. No.57195 of 2025(4) dt.07-11-2025 2/2 transpired in the confessional statement of co-accused namely, Aniket Kumar. Petitioner has clean antecedent and he is in custody since 14.02.2025. Similarly situated co-accused person has already been granted regular bail by a coordinate Bench of this Court vide order dated 11.09.2025 passed in Cr. Misc. No. 46439 of 2025.

5. Learned counsel for the State opposes the prayer for bail.

Considering the facts and circumstances of the case and also considering period of custody of the petitioner and similarly situated co-accused person has been granted bail, his prayer for regular bail is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Barh, Patna in Athmalgola P.S. Case No. 48 of 2025.
