====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 23-08-2023 Heard Mr. Harsh Anuj, learned counsel appearing on behalf of the petitioner and Mr. Sanjay Kumar Singh, learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Garkha P.S. Case No. 210 of 2020, registered under Section 392 of the Indian Penal Code.

3. As per the allegations made in the F.I.R. four unknown miscreants looted motorcycle bearing Registration No. BR-04AD-4039, two mobile phones, Rupees Ten thousand along with some departmental papers and key of the informant on the point of pistol.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is not named in the F.I.R. He further submits that the name of the petitioner surfaced on the basis of confessional statement of co-accused Sanjay Singh

Patna High Court CR. MISC. No.55003 of 2023(2) dt.23-08-2023 2/2 recorded in Police custody and has no evidentiary value. The petitioner has one criminal antecedent in which he is on bail.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

6. Having considered the rival submission made on behalf of the parties as well as the fact that petitioner is not named in the F.I.R. and his name has been taken by co-accused with whom the petitioner has inimical term, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-X, Chapra, Saran in connection with Garkha P.S. Case No. 210 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Purnendu Singh, J) manish/- U T
