The petitioner seeks pre-arrest bail in connection with Wajirganj P.S.Case No. 356 of 2017 registered under Sections 467, 468, 420, 120-B of the Indian Penal Code and Section 7 of the Essential Commodities Act.
It is submitted by the learned counsel for the petitioner that save and except wild suspicion and hypothetical presumption, there is no material to corroborate the allegation that the bags of wheat and rice found in the godown of the petitioner were stored for the purpose of black-marketing. It is submitted that the petitioner is an old widow aged about 65 years and has got no criminal antecedent.

No.18313 of 2018 (2) dt.05-04-2018 2/2 Having regard to the nature of allegation and the submission made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st, Gaya in connection with Wajirganj P.S.Case No. 356 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
