The petitioner seeks pre-arrest bail in connection with Buniyadganj P.S.Case No. 212 of 2017 registered under Section 376/511 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the instant case has been instituted by the informant in retaliation to Buniyadganj P.S.Case No. 211 of 2017 instituted on the same day on the basis of written statement made by the wife of the petitioner in which the informant and one another has been made accused for the offences punishable under Sections 454, 380 and 511 of the Indian Penal Code. Considering the facts and circumstances of the case and the submissions made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Gaya in connection with Buniyadganj P.S.Case No. 212 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
