JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 328, 494 and some other ancillary Sections of the Indian Penal Code.

As per the prosecution case, the informant was married to this petitioner 12 years ago and two children were born from the said wedlock but after some time this petitioner along with his family members started abusing and assaulting her and and finally they ousted her from her matrimonial house. Thereafter, it is alleged that this petitioner married with another girl, Rina Kumari.

Learned counsel appearing for the petitioner submits that entire prosecution case is false and concocted and due to some petty dispute between the petitioner and the informant she

Petitioner is in custody since 18.06.2020 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Muzaffarpur in connection with Deoriya PS case No.17/2020.
