JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-06-2024 The present petition has been filed for restoration of a restoration petition bearing MJC No. 862 of 2023, which in turn was filed for restoration of a writ petition bearing CWJC No. 12625 of 2015, which had stood dismissed for want of prosecution, by an order dated 20.12.2022.

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to file a fresh writ petition, however, submits that it be indicated that dismissal of the aforesaid writ petition, for want of prosecution, may not be construed to be a bar to filing of a fresh writ petition. Liberty so sought is granted.

The aforesaid petition stands disposed off as not pressed,

Patna High Court MJC No.2274 of 2023(2) dt.28-06-2024 2/2 however, with an observation to the effect that in case the petitioner files a fresh writ petition for redressal of his subsisting grievances, if any, within a period of three months from today, dismissal of the aforesaid writ petition for want of prosecution shall not prejudice his case.
