JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-04-2017 The petitioner seeks regular bail in connection with Harlakhi P.S. Case No. 93 of 2016, registered for offences punishable under Section 366, 366A/34 of Indian Penal Code. Allegation against the petitioner that he and other coaccused person kidnapped the informant's daughter for the purpose of her marriage with the present petitioner. It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Further the girl in her statement recorded under Section 164 Cr.P.C. has stated that it is the petitioner, who brought her to her house and except that she has not stated anything so as to connect the petitioner with the present case. Petitioner has been in custody since 15.11.2016 and

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, nature of allegation, period of custody and also that girl in her statement recorded under Section 164 Cr.P.C, has not alleged anything against the petitioner, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five) with two sureties of the like amount each to the satisfaction of learned SDJM, Benipatti, Madhubani in connection with Harlakhi P.S. Case No. 93 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates

Patna High Court Cr.Misc. No.14472 of 2017 (3) dt.21-04-2017 3/3 without showing any genuine reasons, the prosecution will be free to move for cancellation of his bail bonds.
