JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 18-12-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under Sections 7 of the Essential Commodities Act.
The petitioner is a P.D.S. Dealer. He has been proceeded under Section 7 of the Essential Commodities Act on the ground of short supply as well as supply of trade items at a higher rate.
The petitioner submits that his P.D.S. license has been cancelled. He further submits that he could not make regular supply to the consumers due to short supply of Trade Articles by the Government.
In the circumstances, in the event of arrest or surrender before the court below within four weeks from today, the above named petitioner be released on bail on furnishing bail
Patna High Court Cr.Misc. No.50215 of 2015 (4) dt.18-12-2015 2 / 2 bond of Rs.5000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Sitamarhi in connection with Bela P.S. Case no. 09 of 2015 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
