JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Complaint Case No. 2816 (C)/2012 in which cognizance has been taken under Sections 406, 420, 323, 467, 468 of the Indian Penal Code.

The accusation against the petitioner is that he sold 81⁄2 dhur lands to opposite party no. 2 who subsequently got constructed his house over the aforesaid land but the petitioner took loan from L.I.C. mortgaging the aforesaid sold land. Learned counsel for the petitioner drew my attention

Patna High Court Cr.Misc. No.19297 of 2018 (2) dt.05-04-2018 2/2 towards Annexure-4 to the petition and submitted that as a matter of fact, petitioner has taken loan from L.I.C. against a flat and moreover, he has already repaid the loan amount and the aforesaid flat has already been released.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Priya Shekhar, Judicial Magistrate 1st Class, Patna in Complaint Case No. 2816 (C)/2012 subject to condition as laid down under Section 438(2) of the Cr.P.C.
