Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34/120(B) of the Indian Penal Code and Section 27 of the Arms Act.

According to FIR, some unknown persons shot dead to Pankaj Singh.

Name of the petitioner transpired in the evidence of witness Kundan Kumar that this petitioner and co-accused Chunnu Thakur were the real assailants. Said Rakesh Kumar @ Chunnu has already been allowed bail by the learned 9th Additional Sessions Judge, Muzaffarpur in B.P. No. 1472 of 2015 on 15.12.2015. Prayer for bail of this petitioner was refused by the learned 2nd Additional Sessions Judge, Muzaffarpur in B.P. No.

Considering the aforesaid facts, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur/successor Court in connection with Sadar Police Station Case No. 79 of 2013.

The learned District Judge, Muzaffarpur shall take care in allotment of cases of bail matter also so that conflicting orders may not be passed in similar type of allegation. (Birendra Kumar, J) kundan/- U T
