23-09-2016 The petitioner apprehends his arrest in relation to Sasaram Model P.S. Case No. 706 of 2016 registered under Sections 409, 120(B) of the Indian Penal Code.
The petitioner was a Circle Officer at Sasaram. The allegation is that in spite of he being suspended and had been directed to handover the charge he absconded and did not handover the charge. Learned counsel for the petitioner submits that all this has been done at the behest of local MLA who was making pressure for certain mutation to be done in favour of persons in their favour in respect of land, which was government land. The petitioner had refused it and
Patna High Court Cr.Misc. No.41738 of 2016 (2) dt.23-09-2016 seriously contesting the matter which was not liked by the MLA concerned, and therefore, being influenced, he was suspended. He threatened the petitioner which was reported to the authorities. Due to fear of life, the petitioner fell sick which matter was also reported to the Collector, but as the matter related to the MLA, petitioner has become helpless in the matter.
Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the above named petitioner, namely, Vinod Kumar, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram Model P.S. Case No. 706 of 2016, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
