The petitioner is apprehending his arrest in connection with Town P.S.Case no.692 of 2017 , registered for offences punishable under Sections 25(1-A), 26/35 of the Indian Penal Code. Allegation against the petitioner as per FIR is that the police arrested two accused persons and recovered some articles and they have confessed that the petitioner has also carrying one katta and he has fled away.

Submission of the learned counsel for the petitioner is that there is no recovery and except confession there is nothing against the petitioner and he has clean antecedent.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.20984 of 2018 (2) dt.02-05-2018 2/2 circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on the basis of submissions as stated above and try to dispose of if possible on the same day.
