The sole petitioner, apprehending his arrest in R.P.F. Post Garhara P.S. Case No. 06 of 2016 registered for offence under Section 3 of Railway Property (Unlawful Possession) Act, 1966, has prayed for grant of anticipatory bail. By way of referring to F.I.R., learned counsel for the petitioner submits that none had seen the occurrence. Learned counsel for the petitioner submits that the petitioner is having clean antecedent, however; due to village politics, the petitioner has been implicated. In view of facts disclosed in the F.I.R. as well as nature of accusation, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Baiju Bind @ Baiju Nishad be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Barauni, District - Begusarai in connection with R.P.F. Post Garhara P.S. Case No. 06 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
