Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner apprehends his arrest in connection with Mahila P.S. Case no. 168 of 2019 registered under section 498A of the Indian Penal Code as well as section 3/ 4 of the Dowry Prohibition Act.

The main submission advanced by the learned counsel for the petitioner is that the informant married with the petitioner in the year 2009 and as per prosecution story mentioned in the complaint petition last cruelty was committed by this petitioner and other co-accused persons on 18.5.2016 but

No.64538 of 2021(2) dt.16-06-2022 2/2 the complaint was filed on 9.9.2019 after a great delay of 3 years 4 months and before the court below conciliation meeting was held in between the parties in which the complainant failed to go in the company of the petitioner and the petitioner is still ready to keep his wife with full honour and dignity and one son was born from the said wedlock.

Learned APP opposes the prayer for anticipatory bail. Having considered the above submissions and mainly that marriage of the complainant was solemnized in the year 2009 with this petitioner and considerable delay was made by the complainant in lodging the present case with regard to alleged cruelty having arisen, in light of these facts, petitioner deserves anticipatory bail. Let the above named petitioner, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Bhojpur in connection with Mahila P.S. Case no. 168 of 2019 subject to condition as laid down under section 438(2) Cr.P.C.
