Learned counsel for the petitioner is permitted to make correction in Para-1 of the petition with regard to the sections of the alleged offence.
The petitioners seek bail in Shankarpur P.S. Case No. 127 of 2016 registered under Sections 354B, 366, 380 and other sections of the Indian Penal Code.
The informant alleged that she was living at the residence of her maternal grand-father from her childhood. Her marriage was solemnized with Ashok Kumar Yadav in the year 2015. On the eve of Durga Pooja, her cousin brother Subhash Kumar Yadav along with Monu Kumar Yadav came to the house of her maternal grand father to see fair and Arbind Yadav, Nunulal
Patna High Court Cr.Misc. No.19174 of 2017 (2) dt.28-04-2017 2/2 Yadav, Mantun Yadav and Palti Yadav (the petitioners) also came there. The informant made allegation that the accused persons blamed her of illicit relationship with Monu Yadav and they forced her to marry with Monu Yadav.
Leanred counsel for the petitioners submits that the petitioners are, of course, named in the F.I.R., but no specific allegation has been made against the petitioners. The occurrence took place on 09.10.2016 and F.I.R. was lodged on 29.11.2016. Similarly situated co-accused Nunulal Yadav has already been granted regular bail.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1st-cum-Special Judge, POCSO Act, Madhepura in connection with Shankarpur P.S.
