The petitioner apprehends his arrest in connection with Murliganj P.S. Case No. 456 of 2018 for the offence registered under Sections 302/34 of the Indian Penal Code. The allegation is regarding the accused persons, namely, Mira Devi and Ramesh Sharma along with five accused persons having reached at the house of the informant and thereafter they had fired at the deceased Fulo Devi resulting in her death.

The learned counsel for the petitioner submits that the petitioner has not been named in the FIR, his name has transpired belatedly in the supervision note of the Sub-Divisional Police Officer, Madhepura and some witnesses have stated about the complicity of the petitioner. It is further submitted that the

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on anticipatory bail in the event of his arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 456 of 2018 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure.

It is needless to state that the petitioner would mark his presence before the Officer In-Charge of the concerned Police Station at 10:00 A.M. on each and every Monday of the month and on account of his failure on two consecutive occasion to mark his attendance, the present privilege of anticipatory bail shall stand cancelled automatically and the petitioner shall be taken into custody forthwith.
