JUSTICE ARUN KUMAR ORAL ORDER 16-02-2017 Heard learned counsel for the petitioner and the State. Petitioner is in custody in connection with G.O. Case No. 538 of 2016 registered under section 30(A) of the Bihar Prohibition Excise Act, 2016.

Allegation in brief is that 32 bottles of foreign liquor each containing 750 ml. kept in a bag was recovered from inside the bus.

It is submitted that the bus was crowded. The bag did not belong to the petitioner, so it was not recovered from his possession and he has clean antecedent.

Considering the said facts and circumstances, the petitioner, namely, Pawan Kumar @ Dhiraj Kumar @ Pawan Kumar Dhiraj is directed to be released on bail on furnishing bail

Patna High Court Cr.Misc. No.6701 of 2017 (2) dt.16-02-2017 bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawadah in connection with G.O. Case No. 538 of 2016.
