In this application for anticipatory bail the petitioner apprehends his arrest in connection with Khagaria P.S. Case No. 358 of 2016 for the offences punishable under sections 420 and 406 of the I.P.C.
Allegedly, the petitioner received Rs. 1,50,000/- to supply potato to the informant but the petitioner and other accused did not supply the potato to the informant and lastly they refused for the same.
Submission is of false implication and that no offence under sections 420 and 406 of the I.P.C. is made out, now good sense has prevailed and both the parties have compromised the case and as such now the petitioner deserves sympathetic

The learned A.P.P. fairly submits that in view of compromise; vide Annexure-2, now lenient view can be taken. In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Khagaria in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
