2. The petitioner apprehends his arrest in connection with Piribazar P.S. Case No. 28 of 2023 instituted under Sections 448, 323, 325, 307, 379, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, when the informant was constructing his house all the accused persons including the petitioners entered the informant's house and started stopping the construction work of his house and assaulted and abused the informant and his family members.

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has falsely been implicated in

Patna High Court CR. MISC. No.60511 of 2023(2) dt.11-10-2023 2/2 this case due to previous enmity and village politics. He further submits that there is land dispute between the parties and there is case and counter case in which both the sides got injuries however, the injuries are simple in nature. Petitioner has no criminal antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount to each to the satisfaction of the learned A.C.J.M.-II, Lakhisarai in connection with Piribazar P.S. Case No. 28 of 2023 , subject to the laid down in conditions Section 438(2) of the Code of Criminal Procedure, 1973. (Sunil Dutta Mishra, J) ashutosh/- U T
