JUSTICE BIRENDRA KUMAR ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 419/420/467/468/120B/34 of the Indian Penal Code.
Four persons executed registered sale-deed on 12.06.2015 in favour of one Chandrakala Devi. Out of the four persons one is the petitioner.
Allegation is that two different persons impersonated for informant Lalan Chauhan and Somri Devi, who are also said to be the executants of the sale-deed. There is no dispute that petitioner is a co-sharer.
Learned counsel for the informant opposed the prayer on the ground that the petitioner had knowledge about the
Patna High Court Cr.Misc. No.13280 of 2017 (2) dt.22-03-2017 2/2 real Lalan Chauhan and Somri Devi and in his presence some other person impersonated, therefore, petitioner is also liable for the same. Moreover, the entire things happened in conspiracy with the petitioner.
Considering the entire facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada/Successor Court, in connection with Nawada Town P.S. Case No.189 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
