JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-02-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Parriya P.S. Case No. 81 of 2005 for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner was earlier granted bail by a Bench of this Court vide order dated 17.01.2007 passed in Cr. Misc. No. 1379 of 2007 but he has misused the privilege of bail and as such, his bail bond was cancelled by the court below vide order dated 10.12.2009.
Learned counsel for the petitioner submits that the petitioner has gone out of the State in order to earn his bread and butter and as such, he could not make pairvi earlier which resulted in cancellation of his bail bond.
Considering the fact that the petitioner was earlier
Patna High Court CR. MISC. No.53934 of 2019(7) dt.03-02-2020 2/2 granted bail on merit, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of A.D.J. IV, Gaya in connection with Parriya P.S. Case No. 81 of 2005, subject to the condition that petitioner shall cooperate and attend the court proceeding on each and every date during trial and in the event of failure to do so, the court below shall be at liberty to cancel his bail bond. The court below is directed to expedite the trial and conclude the same within a period of nine months from today without granting unnecessary adjournments.
