JUSTICE SUDHIR SINGH ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Basnahi P.S. Case No. 53 of 2016 for the offences instituted under Sections 7 of the E.C. Act and Section 34 of the Indian Penal Code.

It is alleged that the petitioner being the owner of the mill used to sell the government subsidy rice in less market price and for the said purpose the said rice has been stocked and no paper has been produced by him in course of enquiry. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation

Patna High Court Cr.Misc. No.42005 of 2016 (4) dt.15-12-2016 2/2 of tampering of witnesses alleged against the petitioner. The petitioner is a rice miller. A raid was conducted and 601 bags were found on the truck and 719 bags were found in the godown along with 90 other bags, which were in process for preparing rice. Some of the bags were having the mark of government of Punjab. Such bags are available in the market. The seized articles have already been released in favour of the petitioner vide order dated 06.12.2016 passed in C.W.J.C. No. 17134 of 2016. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, the provisional bail granted to the petitioner vide order dated 03.10.2016, is hereby, confirmed.
