The petitioner apprehends his arrest in connection with Bihta P.S. Case No.205 of 2019 registered under Sections 147, 149, 341, 448, 323, 307, 379, 504, 506 and 427 of the Indian Penal Code. The accusation is that Om Prakash Singh, Rakesh Kumar alias Bablu, Monakiya Devi and this petitioner, who are the neibhours of the informant Anita Devi, along with four others assaulted the informant and also took her ornaments after breaking the door of the house. At that time, on the instruction of Monakiya Devi, this petitioner gave Garasa blow at the informant causing cut injury on her left eye. Thereafter, all damaged the room of the house of the informant and broken the glasses of the rooms. In that course, Rakesh Kumar alias Bablu dashed the mother-in-law of the informant

Patna High Court CR. MISC. No.50053 of 2019(2) dt.09-08-2019 2/2 and took Rs.30,000/-, as kept by her in the suitcase. Learned counsel for the petitioner submits that the informant is the cousin sister-in-law of the petitioner and both used to reside in the same house in separate portion. Due to family dispute, the informant has lodged the present case. Moreover, the injury as found on the person of the informant is simple in nature caused by hard and blunt substance and not by sharp cutting weapon. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Danapur, Patna, in connection with Bihta P.S. Case No.205 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
