Petitioner apprehends his arrest in connection with Rosera P.S.Case No. 289 of 2016 registered for the offences punishable under Sections 341, 323, 307, 354, 504 and 506/34 of the Indian Penal Code.

Allegation against the petitioner is of assault by iron rod on the waist of the informant, causing injury to him. Submission of learned counsel for the petitioner is that injury on the person of informant is only abrasion and there is case and counter case between the parties with respect to land dispute and a Title Suit is going on between the parties. Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.19388 of 2018 (2) dt.11-04-2018 2/2 circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rosera, Samastipur, in connection with Rosera P.S.Case No. 289 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
