====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 15-05-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the complainant.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code.
3. The dispute between the parties is with regard to payment of loan amount for purchasing of land but the petitioners did not register sale deed in the name of the complainant as agreed upon by them.

4. Earlier, the matter had also been referred to the Patna High Court Mediation Centre for resolution of disputes between the parties, but the mediation process failed.
5. Vide the last order dated 24.04.2025, it was indicated that the petitioners were ready to make a payment of Rs. 6,81,750/- which according to them remained outstanding and still due to the complainant and learned counsel for the petitioners would produce a draft of the same amount to be handed over to learned counsel for the complainant.
6. Today, a bank draft of an amount of Rs. 6,81,750/- bearing DD No. 049011 is produced before the Court and the same is being handed over to learned counsel appearing for the complainant and he receives the same and a copy of the draft is also being kept on record.
7. In such view of the matter, I am inclined to grant the privilege of anticipatory bail to the petitioners having clean antecedent. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with

8. However, the complainant would have the liberty to pursue the civil remedies available to him for redressal of his grievances.
