JUSTICE BIRENDRA KUMAR ORAL ORDER 01-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/148/ 149 /427 /353 / 124A /121A/302 of the Indian Penal Code, Sections 3/4/5 of the Explosive Substances Act and Sections 16/17/18/19/20/38 of the Unlawful Activities Prevention Act.

Allegation is that extremists killed six police personnel and torched the police vehicles.

Submission of the petitioner is that petitioner and several others have been named in the F.I.R. along with some unknown persons merely on suspicion, and similarly situated some other co-accused have been allowed bail by different coordinate

Patna High Court Cr.Misc. No.20609 of 2017 (2) dt.01-05-2017 2/2 Benches of this Court in Cr. Misc. 39413 of 2016 and Cr. Misc. No.51768 of 2016.

Considering the aforesaid facts as well as the fact that there is mere suspicion against the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Aurangabad/Successor Court, in connection with Navinagar P.S. Case No.174 of 2013, corresponding to S.T. No.342D of 2014/261 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
