The petitioner seeks bail in a case registered under Sections 302/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner took the aunt of the informnat for execution of sale deed of gharari land at Dumra registry office by committing cheat and when she denied, the accused persons committed her murder.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.3.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged

Patna High Court CR. MISC. No.52962 of 2019(2) dt.23-08-2019 2/2 against the petitioner. Merely on the basis of suspicion, the name of the petitioner has transpired in the present case. There is no eye witness to the alleged occurrence. There is no external injury on the body of the deceased. Cause of death could not be ascertained.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. case No.397 of 2017.
