JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-01-2023 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Bihiya P.S. Case No. 220 of 2020 registered for offence punishable under sections 341, 323, 504, 506, 354, 379/34 of the Indian Penal Code.

As per allegation, when the son of the informant was returning his field, co-accused Raj Kumar Singh, petitioner Rishi Singh and Nandan Singh scuffled him. Raj Kumar Singh

Patna High Court CR. MISC. No.64254 of 2021(3) dt.17-01-2023 2/2 pointed pistol on his temporal region. Later on, the accused persons badly assaulted the family members of the informant. Raj Kumar Singh snatched gold chain from the person of the informant.

The learned counsel for the petitioners has submitted that both the parties are agnates. There is land dispute between them. The petitioner are the persons of clean antecedents and no one has sustained any kind of injury. He has also submitted that co-accused Raj Kumar Singh has been granted anticipatory bail, vide Cr. Misc. No. 22651 of 2021.

Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate-IV, Bhojpur at Ara in connection with Bihiya P.S. Case No. 220 of 2020, subject to condition as laid down under section 438(2) Cr. P.C. (Nawneet Kumar Pandey, J) Mahesh/- U T
