JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,447,323,427,353,384,504 and 506 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
The prosecution case is that since the informant being Sarpanch of Harda Gram Kachahari decided Case No. 17 of 2012 against the accused persons hence getting annoyed they entered into the court premises of the informant, destroyed the furniture and abused the informant by calling caste name.
Patna High Court Cr.Misc. No.35032 of 2015 (2) dt.19-08-2015 2/2 It is submitted by the learned counsel for the petitioner that on conclusion of investigation the petitioner was not sent up for trial but differing with the final form, cognizance has been taken.
Considering the fact that the accusation was not found true during investigation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with SC/ST Purnea P.S. Case No. 88 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
