Petitioner is seeking anticipatory bail in Gayghat P.S. Case No. 75 of 2017 for the offences registered under Sections 467, 468, 471 and 420 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against this petitioner is that he, being a member of the AAM SABHA in his capacity as Mukhiya of the concerned Gram Panchayat, had appointed Arti Devi as Anganwadi Sevika on the basis of a fake income certificate. Learned counsel submits that there is no allegation that this petitioner had fabricated the said income certificate, moreover, Arti Devi has been granted privilege of anticipatory bail in Cr. Misc. no. 37470/2017. Learned counsel for the State is present.

Rai, learned A.C.J.M. 15, Muzaffarpur in connection with Gayghat P.S. Case No. 75 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
