23-04-2018 Heard Sri Barun Kumar Choudhary, learned counsel for the petitioner and Sri Ram Bilash Roy Raman, learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Maniyari P.S. Case No. 248 of 2014 registered for offence under Sections 414, 420/34 of the Indian Penal Code, Section 47(F) of the Excise Act, 1944 and Sections 63, 65 of Copy Right Act, has prayed for grant of bail in the event of his arrest or surrender. By way of referring to F.I.R., learned counsel for the petitioner submits that it was registered long back in the year 2014 against four named accused persons, however; only recently the petitioner has been made accused on the basis of confessional statement of co-accused. Learned counsel for the petitioner submits that petitioner is having clean antecedent,
Patna High Court Cr.Misc. No.23017 of 2018(2) dt.23-04-2018 2/2 which fact has been stated in paragraph - 3 of the petition. Considering the fact that petitioner's name has come on confessional statement of co-accused in a case, which was registered long back in the year 2014, and clean antecedent, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Hriday Rai @ Hirdan Rai be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise Act), Muzaffarpur in connection with Maniyari P.S. Case No. 248 of 2014, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
