Petitioner apprehends his arrest in connection with Mairwa P.S. Case No.09 of 2019 registered for the offence punishable under sections 341, 323, 307, 302, 34 of the IPC and Section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that earlier prayer of the petitioner was rejected by this Court vide Cr. Misc. No.31975 of 2019 on 16.05.2019 on merit. Further submits that petitioner is innocent and has committed no offence and he has falsely been implicated in this case and the mode and manner as alleged has taken place, and the entire prosecution story is false. Patna High Court CR. MISC. No.50990 of 2019(7) dt.19-02-2020 2/2 opposes the prayer of anticipatory bail of the petitioner and submits that there is specific allegation against the petitioner to gun fire upon Manu Yadav and doctor referred Manu Yadav for higher center. Further submits that there is sufficient material in the case diary.

Considering the nature of allegations levelled and the submissions advanced on behalf of the parties, this Court does not find any fresh ground for grant of anticipatory bail to the petitioner. The same is, therefore, rejected. The petitioner is directed to surrender before the learned lower court within two weeks from the date of receipt/production of a copy of this order (Arvind Srivastava, J) Prakash Narayan /- U T
