Petitioner apprehends his arrest in a case registered for the offence punishable under Section 30 (a)/41 of the Bihar Prohibition & Excise Act.

As per the prosecution case, 425 liters of country made liquor has been recovered from near Devi Sthan of Rasanpur village.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery.

Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits petitioner has got

Patna High Court CR. MISC. No.54246 of 2022(3) dt.02-12-2022 2/2 criminal antecedent of similar nature.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on pre arrest bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
