This is a petition for grant of anticipatory bail for offence under Sections 467, 468, 471, 419, 420, 379, 120B and 34 of the Indian Penal Code.

According to first information report a gang of unsocial elements were cheating the people by running a scheme that identify photograph and get prize. The petitioner is not named in the first information report. During investigation name of the petitioner was disclosed that he is master-mind of the gang. Submission of the petitioner is that the petitioner has got no criminal antecedent.

In fact, name of Soni Kumar, son of Suresh Prasad was disclosed by one co-accused, Awadhesh Kumar as the main culprit. This petitioner is not son of Suresh Prasad. Though name of Sanjay Kumar has appeared in the first information report, but, his parentage is not mentioned nor the case diary reveals that the parentage of said Sanjay Kumar was ascertained. Considering the aforesaid fact, the petitioner, above

No.46650 of 2016 (4) dt.19-12-2016 named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sheikhpura P.S. Case No. 273 of 2014 to the satisfaction of the Chief Judicial Magistrate, Sheikhpura, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
