JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Khagaul P.S. Case No. 88 of 2016 registered for the offences punishable under Sections 419, 420, 406, 467, 468, 471, 472, 120B of the Indian Penal Code.

Petitioner is named in the first information report with allegation that he along with others took huge amount to get the informant and others provided job in railway. No doubt, the informant and others made attempt to get entry in the government job through back gate and for that they illegally paid huge amount to petitioner and others but considering the nature of allegation levelled against the petitioner

Patna High Court Cr.Misc. No.43453 of 2016 (3) dt.15-12-2016 2/2 as well as facts and circumstances of the case, I do not feel it proper to extend the privilege of anticipatory bail to petitioner. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Khagaul P.S. Case No. 88 of 2016 pending in the court of Additional Chief Judicial Magistrate, Danapur, Patna stands rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
