The petitioner has moved the Court to direct payment of family pension as her late husband was an employee under the respondents no. 3 to 6.
Learned counsel appearing for the respondents no. 3 to 6 submits that the petitioner has to apply in proper format for payment of pension which would be granted by the Assistant Provident Fund Commissioner, E.P.F., Muzaffarpur and they are only required to forward such application.
In view of the aforesaid, the writ petition stands
Patna High Court CWJC No.7073 of 2015 dt.23-09-2015 2/2 disposed off with a direction to the petitioner to appear before the respondent no. 6 within two weeks from today along with a copy of this order. The respondent no. 6 shall ensure that all formalities required to be completed by the petitioner are so done within two weeks thereafter. The respondent no. 6 shall forward the required papers to the Assistant Provident Fund Commissioner, E.P.F., Muzaffarpur within the next one week. It is expected that the Assistant Provident Fund Commissioner, E.P.F., Muzaffarpur shall ensure that all admitted dues of the petitioner are paid within four weeks from the receipt of the form by him. The petitioner shall also serve a copy of the order on the Assistant Provident Fund Commissioner, E.P.F., Muzaffarpur within two weeks from today.
