The petitioner is languishing in custody in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
It is a case of commission of robbery in the house of the informant.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner was not apprehended from the spot. The
Patna High Court CR. MISC. No.55761 of 2023(2) dt.05-09-2023 2/2 petitioner has still not been put on T.I.P. The petitioner is languishing in custody since 03.04.2023. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one. Moreover, other similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide order dated 08.04.2022 passed in Cr. Misc. No. 51298 of 2021.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad (Karauna O.P) P.S. Case No. 59 of 2021.
