The petitioners seek bail in a case instituted for the offences under Sections 147, 148, 149, 342, 302, 120B/34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in short is that the accused persons assaulted the husband of the informant and fired upon his back side due to which he sustained injury and later succumbed to the injury.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 15.4.2019 and have got no criminal antecedent. There is no allegation of tampering of

Patna High Court CR. MISC. No.52261 of 2019(2) dt.22-08-2019 2/2 witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. The allegation of assault is against Tufna Yadav and Charpa Yadav. The petitioners are said to be member of unlawful assembly. Except for this, there is no other substantive evidence to suggest his implication in the present case. No allegation of assault is alleged against the petitioners.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -3rd, Naugachia, Bhagalpur/ successor Court in connection with Gopalpur (Rangra) P.S.
