The petitioner seeks bail in Industrial Area P.S. Case No. 145/2016, registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and sections 25(1B)A, 26 and 35 of the Arms Act. The informant a police officer got information that some criminals had assembled to commit cognizable offence and on such, the informant along with other police officials raided the place and apprehended four persons namely, Indresh Kumar, Krishn Kumar Singh @ Munna, Vikram Kumar and Rupesh Kumar. From the possession of the apprehended accused different arms and ammunitions and other articles including mobiles were

Patna High Court Cr.Misc. No.15788 of 2017 (2) dt.25-04-2017 recovered. The apprehended accused is said to have disclosed the name of petitioner.

Learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. Save and except the fact that the name of the petitioner figured in the case on the basis of confessional statement of the co-accused. The Investigating Officer did not collect any tangible material and petitioner is in jail since 27.11.2016.

Considering the facts aforesaid and the fact that nothing has been recovered from the possession of the petitioner, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Vaishali at Hajipur in connection with Industrial Area P.S. Case No. 145/2016.
