1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The present application has been filed for modification of the order dated 03.12.2024 passed in Cr. Misc. No. 78827 of 2024 whereby the present petitioners have been granted privilege of anticipatory bail subject to the condition that the petitioners shall surrender before the learned court below within a period of four weeks from the date of order.
3. Learned counsel for the petitioners submits that the petitioners could not surrender within time since at the relevant point of time the father and mother of the petitioner no. 1 fell ill and both petitioners got engaged in their treatment. He,
Patna High Court CR. MISC. No.53441 of 2025(2) dt.01-08-2025 2/2 accordingly, prays for further two weeks time to surrender before the learned District Court.
4. From perusal of the records and submission made by the parties and the fact that the petitioners are not willing to refund / deposit the balance amount of Rs. 18,06,292/- in four installments as quantified by this court and agreed upon by the petitioners at the time of granting bail, I find no merit in the prayer made by learned counsel for the petitioners.
