JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-11-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Sahkund (Sajour) P.S. Case No. 105 of 2016 registered under Section-379 of the Indian Penal Code, Section-40 of Bihar Minor Mineral Concession Rules, 1972 & 6/8 of Bihar Mineral (Prevention of illegal Mining, Transportation and Storage) Rules, 2003.
The informant got confidential information that some persons are storing sand on the land of Devendra Bhandari. He went there and the local chowkidar disclosed that petitioners and some others had stored the above-said sand.
Patna High Court Cr.Misc. No.42848 of 2016 (2) dt.28-11-2016 2/2 Considering the above-said facts and circumstances of the case as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioners named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Sahkund (Sajour) P.S. Case No. 105 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Bhagalpur subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
