JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-03-2017 The petitioner is in custody since 26.10.2016 in connection with K. Nagar P.S. Case No. 389 of 2016, registered for offences punishable under Sections 394 and 411 Indian Penal Code.

It has been submitted on behalf of the petitioner that petitioner has not been named in the F.I.R, he has falsely been implicated in this case and other three co-accused persons have already been granted bail by this Court and petitioner has been languishing in judicial custody since 26.10.2016. Learned counsel for the State opposed the prayer for bail. Having heard both sides, in view of the fact that there is recovery of looted articles from the possession of the petitioner, I am not inclined to grant the petitioner, the privilege of regular bail,

Patna High Court Cr.Misc. No.9851 of 2017 (5) dt.27-03-2017 2/2 it is accordingly rejected.

However, since the petitioner has remained in judicial custody for more than six months, trial court is directed to expedite the trial and try to conclude as soon as possible preferably within a period of nine months.
