The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 and 120B of the Indian Penal Code.

The accusation against the petitioner is that without repayment of the loan amount to the bank, he sold the tractor which was purchased with the loan sanctioned by Madhya Bihar Gramin Bank, Baijnathpur branch. Learned counsel for the petitioner submits that the petitioner is ready to settle the dispute and the issue with regard to loan dispute of co-accused has been referred to Lok Adalat.

Hence, in view of the aforesaid

Patna High Court Cr.Misc. No.9542 of 2018 (2) dt.17-02-2018 2/2 circumstances and in view of the accusation arose out of civil nature of dispute, let the above named petitioner be released on anticipatory bail provisionally for six months, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Nawada in connection with Narhat P.S. Case No. 152 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

In the meantime, let the learned Court below issue notice to the informant and the learned Court below also try to resolve the issue between the parties. On resolution of the dispute between the parties, the provisional bail of the petitioner will be confirmed by the learned Court below. The learned Court below shall be at liberty to extend the period of provisional bail, if need arises.
