Petitioner is accused in connection with Special (POCSO) Case no. 101 of 2016 arising out of Dulhin Bazar P.S. Case No. 134 of 2016 registered for the offences under Sections 376/511 of the I.P.C. and section 8 of the POCSO Act. Learned counsel for the petitioner submits that the informant in her statement under section 164 Cr.P.C. has differed from the first information report. On medical examination of the victim, it has been reported that rape has not been committed. It is submitted that petitioner has no criminal antecedent and is in custody since 24.07.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on

Patna High Court Cr.Misc. No.17536 of 2017 (2) dt.03-05-2017 2/2 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Patna in connection with Dulhin Bazar P.S. Case No. 134 of 2016.
