Appeal (D.B.) No. 711 of 2015, which was dismissed for default on 08.10.2015. Heard Mr. Bimal Kumar, learned counsel for the petitioner and Mr. A. Sharma, learned Additional Public Prosecutor, appearing for the State.

Having considered the averments made in the application and having heard the learned counsel for the petitioner, we are satisfied that the absence of the petitioner and/or their counsel from the Court on 08.10.2015, was for reasons beyond their control.

In view of the above and in the interest of justice, the restoration application is allowed and Cr.Appeal (D.B.) No. 711 of

Patna High Court Cr.Misc. No.51734 of 2015 (4) dt.18-12-2015 2015, aforementioned is hereby restored to its original file. This Miscellaneous petition shall, accordingly, stand disposed of.

Let Cr.Appeal (D.B) No. 711 of 2015 be listed for admission, on 22.01.2016.
