The petitioner seeks pre-arrest bail in connection with Doriganj P.S. Case No.228 of 2017 registered under Sections 461 and 379 of the Indian Penal Code.

Regard being had to the recovery of stolen mobile from possession of the petitioner, I am not inclined to grant him prearrest bail. Accordingly, the application filed under Section 438 of the Code of Criminal Procedure Code for grant of pre-arrest bail is rejected.

In case the petitioner surrenders and seeks bail, the same shall be considered on its own merits without being prejudiced in
